Terms of Use
These Terms govern your use of the Baby Monitor mobile app and the website at babymonitor.cc (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms.
1. The Service
Baby Monitor helps caregivers stream live video and audio between devices (baby station / parent station), with features such as pairing PIN, push-to-talk, multi-camera viewing, local alerts, and related tools. Features may change over time.
2. Critical safety disclaimer
Baby Monitor is not a medical device, not a diagnostic tool, and not a life-saving or emergency monitoring system. It must not replace responsible adult supervision. Cry detection, connection status, and other alerts can fail, miss events, or produce false alerts. Network outages, device sleep, permissions, battery limits, and hardware issues can interrupt monitoring without warning.
Always check on the child in person. Do not rely on the app as your only means of knowing whether a child is safe, breathing, or in distress.
3. Eligibility & lawful use
- You must be old enough to enter a binding agreement where you live (and at least 18 if you use the app to monitor a child in your care, unless local law says otherwise).
- Use the Service only for lawful, appropriate caregiving purposes.
- Do not use the Service to secretly monitor people without required consent or legal right.
- Do not attempt to disrupt signaling, abuse infrastructure, reverse engineer for harm, or redistribute the app unlawfully.
4. No cloud babysitting archive
The Service is designed around live peer-to-peer media when possible. We do not provide a cloud library of stored baby videos. You are responsible for how you use screen recording or other OS features on your own devices.
5. Accounts
The app does not require creating an account with us. Store accounts (Google / Apple) are governed by those companies’ terms.
6. Permissions & your devices
You must grant camera, microphone, and other permissions the features need. You are responsible for device security, OS updates, network quality, and keeping pairing PINs private.
7. Third-party services
Connectivity may involve STUN/TURN, app stores, and hosting providers. Optional TURN settings you enter are your responsibility. Third-party terms apply to those services.
8. Intellectual property
The app name, branding, website, and software are protected by applicable IP laws. You receive a personal, non-exclusive, non-transferable license to use the app as provided through official store channels.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION, OR THAT ALERTS WILL DETECT EVERY EVENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 20.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example certain consumer rights).
11. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Service, unlawful monitoring, or violation of these Terms.
12. App Store terms
If you downloaded the app from Google Play or the Apple App Store, you also comply with that store’s terms. Apple, Google, and their subsidiaries are third-party beneficiaries of applicable store-related clauses to the extent required by those platforms.
13. Changes & termination
We may update these Terms or discontinue features. Continued use after changes means acceptance. We may suspend access to signaling or related online components for abuse, security, or operational reasons.
14. Governing law
These Terms are governed by the laws of Slovakia, without regard to conflict-of-law rules, unless mandatory consumer protection law in your country of residence requires otherwise.
